Background

Aligned Simplicity Pty Ltd trading as Simply + Fiercely® provides online courses and programs designed to help women simplify their lives, live more intentionally, and reduce overwhelm. These Courses may include content related to decluttering, mindset, habits, and intentional living and are delivered to participants worldwide.

This Course Terms and Conditions (the "Agreement") is a legally binding contract between you (the "Participant") and Aligned Simplicity Pty Ltd ABN 650892176 trading as Simply + Fiercely®. It covers the purchase and delivery of your selected Course.

While it is expected that this Agreement will be signed and returned by you, you are deemed to have read and accepted the Terms and Conditions contained in this Agreement upon receipt by you via email or through our website, AND by continuing to accept and engage the services provided by Jennifer Burger.

TERMS AND CONDITIONS

  • TERM

    1.1 This Agreement will begin upon payment of the advertised Course fees.

    1.2 It will apply for the duration of the Course and completion of any payment plan going beyond the Course's length.

  • COURSES

    2.1 Jennifer Burger provides online courses and programs focused on simplifying life, intentional living, and reducing overwhelm.


    These Courses may include:

    • Self-paced digital programs

    • Online course content and resources

    • Optional live sessions, workshops, or group support.


    Each Course will have its own details, including pricing, duration, and inclusions, which will be outlined at the time of purchase.

  • COURSE FEES

    You understand and agree:


    3.1 Payment options for the Courses are as follows:


    3.1.1 Full payment of the advertised Course fee is required at the time of enrolment.

    3.1.2 All fees are in US Dollars and inclusive of GST where relevant.

    3.1.3 Payment is accepted online by credit card or PayPal via Ivorey (Go High Level).


    3.2 DISCOUNTS AND SPECIAL OFFERS


    3.2.1 The Courses may be offered at time-limited pricing from time to time.

    3.2.2 Discount codes include, but are not limited to:

    3.3 LATE PAYMENTS


    3.3.1 You are responsible for ensuring required payments are made on time.

    3.3.2 Jennifer Burger reserves the right to cease Course access until the due fees are paid.


    3.4 VARIATION


    3.4.1 Pricing is valid for the term of the Agreement.

    3.4.2 Jennifer Burger reserves the right to vary any fees.

    3.4.3 Changes in fees will not affect you and will only apply to future Course offerings.

  • COURSE DELIVERY

    You understand and agree:


    4.1 All Courses will be delivered within the agreed time frame contained in the selected Course package.

    4.2 Courses will be delivered via Ivorey (Go High Level) and may include additional platforms such as Zoom where applicable.

    4.3 Courses may include self-paced content and/or live sessions.

    4.4 Any changes to Course bookings or scheduled sessions must be requested at least 48 hours in advance in writing to [email protected].

  • REFUND POLICY

    You understand and agree:


    5.1 You may withdraw from the Course for any reason within 30 days of purchase.

    5.2 Any refund calculation will include a deduction for bonus services or programs already provided.

    5.3 All refund requests must be made in writing to Jennifer Burger.

    5.4 Refund requests after 30 days of purchase will be managed according to our obligations and your rights as consumers under Australian Consumer Law.

    5.5 Refund requests after 30 days of purchase will be considered case-by-case and are not guaranteed.

  • YOUR OBLIGATIONS


    6.1 To gain the best results from the Course, you agree to:

    • Engage with and complete Course materials

    • Participate in exercises and activities where relevant

    • Attend live sessions where applicable

  • SITE

    The Site, which hosts all programs and resource materials, can only be accessed by Participants.


    7.1 You will respect the confidentiality of Jennifer Burger and other Participants.


    Technology issues

    7.2 If there are any problems with the Site or if the host or network should go down due to circumstances beyond our control, Aligned Simplicity Pty Ltd trading as Simply + Fiercely® shall not be held responsible. However, we will do our best to get the system back up as soon as possible when it is within our control.

    7.3 Aligned Simplicity Pty Ltd trading as Simply + Fiercely® shall not be liable to you or any other party because of viruses or malware that may infect your electronic equipment.

    7.4 You agree that you:


    7.4.1 will not use any robot, spider or other devices, process or means to access the Course;

    7.4.2 will not compromise or circumvent the security controls of the Course or otherwise gain unauthorised access to the Course; and

    7.4.3 will not attempt to interfere with the proper working of the Course.


    Program Dashboard

    7.5 You will be required to register your details to create a password to access the Course's Dashboard's program content.

    7.6 Your login details will be shared to the email address provided at registration.

    7.7 It is your responsibility to ensure the details you provide are correct and current.


    Password security

    7.8 You are solely responsible for the protection and confidentiality of any password that you may have issued to or subscribed for from time to time.

    7.9 You will not share your password with any other person.

    7.10 You will immediately notify us if your password is lost or becomes known to any other person.

    7.11 You are solely responsible for accessing and using this Site via your password, whether such access or use is by you or any other person.

    7.12 The personal information you provide to the Course will be managed according to our Privacy Policy: https://www.simplyfiercely.com/privacy-policy/.

  • INTELLECTUAL PROPERTY AND COPYRIGHT


    8.1 All material on this Site or otherwise delivered by Jennifer Burger including hard copy resources, PDFs, books and digital downloads ("Content"), is subject to copyright.


    8.2 Modifying our content for any other purpose violates our copyright and other proprietary rights and is strictly prohibited.


    8.3 You acknowledge that you do not acquire any ownership rights by using the Site or our Content.


    8.4 The trademarks, logos, and service marks displayed on our Site are the registered or unregistered trademarks of Jennifer Burger.


    8.5 Whether registered or unregistered, the trademarks may not be used in connection with any product or service that does not belong to Jennifer Burger, in any manner that is likely to cause confusion with customers, or in any manner that disparages Jennifer Burger.


    8.6 As a Participant, you are bound, at all times, to ensure that you do not breach our intellectual property rights at any time for any reason.


    8.7 You may not use any of the materials available in the Course or any teaching platform or in a manner that infringes on our rights or has not been expressly authorised by us.


    8.8 All material, including but not limited to videos, call recordings, resource downloads, and templates available in the Course and within any program created by Jennifer Burger, is provided solely for your personal and non-commercial use.

  • USE BY LICENCE ONLY


    9.1 Use of materials for any other commercial purpose is prohibited without the express written permission of Jennifer Burger.


    9.2 You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material the Course or related programs without the express permission of Jennifer Burger. You may request such permission by emailing [email protected].

  • ACKNOWLEDGMENT AND DISCLAIMER

    You understand and agree:


    10.1 The goal of the Course is to help participants live simpler, more intentional lives.


    10.2 Jennifer Burger cannot guarantee your ability to get results or improvements with your skills or otherwise with the course content, tools, ideas, information, or strategies provided.


    10.3 Results are dependent on various factors, including but not limited to your commitment, personal ability, and dedication, and are in no way dependent on any information or training provided to you by Jennifer Burger.


    10.4 You have purchased the Course and engaged Jennifer Burger's services at your own risk.


    10.5 All content, resources, and training are solely provided for personal use and information.


    10.6 Jennifer Burger does not offer any representations, warranties, or guarantees, verbally or in writing, regarding your results from the Courses.


    10.7 Jennifer Burger provides education, training, support, guidance, and tools, but any decision you make and the consequences that flow from such decisions are your sole responsibility.

  • LIMITATION OF LIABILITY


    11.1 Liability for the services provided by the Course Creator is governed solely by the Australian Consumer Law and these Terms and Conditions.

    11.2 Nothing in these Terms removes your Statutory Rights as a consumer under Australian Consumer Law.


    11.3 Jennifer Burger guarantees all courses are supplied to you with due care and skill and fit for the purpose that the services have been advertised.

  • GOVERNING LAW

    You understand and agree:


    12.1 The Terms and Conditions of this Agreement are governed and construed in accordance with the laws of the State of Queensland, Australia.


    12.2 Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the State of Queensland, Australia.


    I have read and agree to the terms and conditions of this Agreement and by continuing with the purchase of this Course I understand that I am legally bound by this contract.
